Terms of Service

1. The Service

TopServer is a directory and ranking site for private game servers. Server owners can list their servers, and visitors can vote for their favorites. We also offer optional paid Premium and Featured placements, and an optional Discord bot for server owners to offer to their community.

2. Service Availability & Changes

We may add, change, or remove features of the Site at any time, and may suspend or discontinue the Site (or any part of it, including the Discord bot) temporarily or permanently, with or without notice. We're not liable to you for any such change, suspension, or discontinuation, though we'll try to honor any Premium/Featured time you've already paid for where reasonably possible.

3. Accounts & Eligibility

You must be at least 13 years old to create an account, and the information you provide when registering must be truthful and accurate. You're responsible for keeping your password confidential and for all activity under your account - let us know immediately if you believe it's been compromised.

4. Server Listings

If you list a server, you're responsible for the accuracy of the information you submit (name, description, connection details, banner). We don't verify or guarantee the uptime, quality, legality, or safety of any listed server - visitors connect to third-party servers at their own risk.

We may edit, unpublish, or remove a listing at our discretion - for example if it's inaccurate, abusive, or violates these Terms.

5. Voting

Votes are limited to one per person per server every 12 hours, enforced by IP address and (if provided) in-game user ID. Using VPNs, bots, scripts, multiple accounts, or any other method to cast extra votes or manipulate rankings is prohibited, and we may remove the affected votes, suspend the listing, or suspend the account responsible.

6. Our Discord Bot

Adding our Discord bot to your server is optional and requires you to grant it certain Discord permissions (e.g. to assign roles or post messages) so it can function. Your use of Discord itself remains subject to Discord's own Terms of Service. You can remove the bot from your server at any time.

7. Premium & Featured Purchases

Premium and Featured are paid placements, priced and described at checkout, processed via PayPal or NOWPayments (cryptocurrency). Once a purchase is activated on your server, it is non-refundable, except where required by applicable consumer law. The Featured slot is exclusive to one server at a time - if it's occupied when you purchase, your purchase queues and activates automatically once it's free, as described at checkout.

8. Prohibited Conduct

You agree not to:

• Manipulate votes or rankings by any artificial means
• Submit false, misleading, or illegal content in a server listing
• Impersonate another person or server, or misrepresent your affiliation with one
• Harvest or scrape other users' data from the Site
• Use the Site to send spam or unauthorized advertising
• Attempt to disrupt, overload, or gain unauthorized access to the Site or bot
• Use the Site for fraudulent payments or chargebacks made in bad faith
• Harass, abuse, or harm other users

9. Intellectual Property

The TopServer name, logo, and site design are our property. You retain ownership of the content you submit (server descriptions, banners, and similar listing content), but by submitting it you grant us a worldwide, royalty-free license to host, display, and distribute it on the Site for as long as your listing is active. We may refuse or remove any submitted content at our discretion, including after it's been published.

10. Indemnification

You agree to defend, indemnify, and hold us harmless from any claim, damages, or expenses (including reasonable legal fees) arising from your use of the Site or bot, the content you submit, or your violation of these Terms.

11. Disclaimers & Limitation of Liability

The Site is provided "as is," without warranties of any kind. We are not responsible for the content, availability, or conduct of any third-party server listed on the Site, nor for any loss arising from your use of a third-party server, payment provider, or Discord. To the maximum extent permitted by law, our liability for any claim related to the Site is limited to the amount (if any) you paid us in the 12 months before the claim.

12. Suspension & Termination

We may suspend or terminate your access to the Site or bot at any time for violating these Terms. You may stop using the Site or remove the bot at any time.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted here with an updated "Last updated" date. Continued use of the Site after a change means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of Spain, without regard to conflict-of-law principles.
